Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Ear & Pitch Training Studios LLC (the “Company,” “we,” or “us”) governing your use of the Pitch Trainer mobile application and related services (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on a device you own or control. We retain all rights not expressly granted to you.

2. Eligibility

The App is intended for users aged 18 and over. By using the App you represent that you meet this requirement and that the information you provide is accurate.

3. Subscriptions and Billing

Certain features require a paid subscription. Subscriptions are sold and billed through the app store from which you downloaded the App (for example, the Apple App Store or Google Play), and payment is charged to the account associated with that store once your purchase is confirmed.

• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the period ends. Your store account is charged for renewal within the 24 hours before the period ends.
• Managing and canceling: You can manage or cancel your subscription, and turn off auto-renewal, in your app store account settings. If you cancel, access continues until the end of the current billing period.
• Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Refunds: Purchases are handled by the app store, and refunds are subject to that store’s policies. We do not separately process payments or refunds.

4. Acceptable Use

You agree not to:

• copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
• resell, sublicense, rent, or otherwise commercially exploit the App;
• use the App in any unlawful manner or to interfere with its operation or security.

5. Intellectual Property

The App, including its content, audio, lessons, design, and trademarks, is owned by the Company and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

6. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any result (such as improvement in musical skill) will be achieved.

7. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

8. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination will survive.

9. Third-Party Stores and Services

Your use of the App is also subject to the terms of the app store from which you downloaded it and any third-party services the App relies on. Where the App is obtained through the Apple App Store, Apple is not a party to these Terms and is not responsible for the App; where obtained through Google Play, Google is likewise not a party to these Terms.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles.
